Terms and Conditions for SMS/Text Messaging Services

These Terms and Conditions (the "Agreement") govern the use of SMS or text messaging services (the "Service") provided by MERCURY TAXES ("we," "our," or "us"), a Certified Public Accountant practice licensed in Ontario, Canada. By subscribing to or using our SMS Services, you agree to be bound by the following terms. If you do not agree with these Terms and Conditions, please do not sign up for or use our Service.

1. Types of Messages You Can Expect to Receive

By providing your phone number to us, you consent to receive SMS communications from MERCURY TAXES. You may receive the following types of messages related to our professional tax and accounting services:

  • Tax Service Communications: Tax filing reminders, deadline notifications, document request alerts, and tax return status updates.
  • Appointment and Consultation Messages: Appointment confirmations, reminders, rescheduling notifications, and consultation follow-ups.
  • Account and Billing Messages: Invoice notifications, payment reminders, account status updates, and billing-related communications.
  • Time-Sensitive Tax Alerts: Important CRA deadline reminders, tax law changes affecting your returns, and urgent compliance notifications.
  • Document and Information Requests: Requests for additional documentation, missing information alerts, and submission confirmations.
  • Service Updates: Notices regarding our services, office hours changes, or other announcements.

2. Message Frequency

The frequency of messages will vary based on:

  • Tax season activity (higher frequency from February to April)
  • Your specific service needs and engagement with our firm
  • Urgent compliance deadlines or CRA requirements
  • Scheduled appointments and consultations

During peak tax season, you may receive multiple messages per week. Outside of tax season, messaging frequency will be significantly reduced. Frequency may also vary based on your individual tax situation.

3. Message and Data Rates

Standard message and data rates may apply from your mobile carrier. These rates are determined by your mobile provider, and MERCURY TAXES is not responsible for any related charges. Contact your provider for details on your SMS plan.

4. Consent and Opt-In

By subscribing to our SMS service, you give express consent to receive the types of messages described above. Consent is not a condition for receiving professional services. You may opt-in by:

  • Providing your phone number during our intake process
  • Submitting your number on our website's SMS signup form
  • Following other instructions during service registration

Messages may include confidential tax or financial information relevant to your account.

5. Opting Out

You can opt out at any time by:

After opting out, you will no longer receive SMS messages. However, we may still send important updates by email or postal mail. To opt back in, reply "START" or contact our office. For help, reply "HELP".

6. Privacy and Confidentiality

Your privacy is important. Any personal or financial information shared via SMS is protected by:

  • Professional Confidentiality: We adhere to CPA standards.

  • Canadian Privacy Laws: We comply with PIPEDA and provincial laws.
  • CRA Confidentiality: We meet CRA’s standards and obligations.

We never share your information without legal obligation or your written consent.

7. Professional Standards and Compliance

All SMS communication follows:

  • CPA Ontario professional conduct standards
  • Canada Revenue Agency rules and requirements
  • Canadian privacy and telecom laws
  • Professional liability and ethics protocols

8. Security and Data Protection

We use reasonable security measures to protect sensitive messages. However, please note that SMS messages are not encrypted and may carry inherent risks when transmitting confidential information.

9. Limitation of Liability

We are not responsible for:

  • Delays or failures in message delivery
  • Carrier-related costs or technical issues
  • Any damages resulting from undelivered or delayed messages
